Terms of Service

1. Acceptance of Terms

By accessing and using the KHAYBAR platform ("Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform. KHAYBAR reserves the right to modify these terms at any time. Continued use of the Platform following any changes constitutes acceptance of the modified terms.

2. Service Description

KHAYBAR operates a luxury hotel uniform design and tailoring platform that connects:

  • Hotel Partners: who define brand standards and order custom uniforms
  • Professional Guides: (designers/tailors) who create and refine designs
  • Production Partners: sub-processors who manufacture garments, bound by Data Processing Agreements
  • Hotel Employees: who are measured and receive uniforms

The Platform provides tools for design collaboration, brand compliance checking, order management, and impact tracking.

3. User Eligibility

You must be at least 18 years old and have the authority to bind the organization you represent. Hotel partners and users must be business representatives acting in an official capacity. By registering, you warrant that all information provided is accurate and complete.

4. Hotel Partner Responsibilities

As a Hotel Partner, you agree to:

  • Provide accurate hotel information, employee rosters, and measurement data
  • Ensure all employee data collection complies with local employment law and GDPR
  • Define brand guidelines and style preferences clearly and completely
  • Review and approve designs in a timely manner before production
  • Pay all invoices according to the agreed payment terms
  • Maintain confidentiality of proprietary design work and brand information

5. Employee Data & Consent

Hotels collect and share employee data (including names, photos, and body measurements) through the Platform. By uploading employee data, Hotels confirm they have:

  • Obtained explicit written consent from each employee (see GDPR Privacy Policy)
  • Informed employees of measurement, photography, and data storage practices
  • Provided employees with access to their rights under GDPR (see Privacy Policy)

KHAYBAR acts as a Data Processor on behalf of the Hotel (Data Controller). Hotels are responsible for obtaining consent and managing employee rights.

6. Guide (Designer/Tailor) Terms

Professional Guides must:

  • Maintain professional credentials verified by KHAYBAR
  • Respect brand guidelines and compliance requirements set by Hotels
  • Communicate clearly with Hotels during design collaboration
  • Not use Hotel data or designs outside the scope of their engagement
  • Maintain confidentiality of all proprietary information

KHAYBAR may disconnect Guides who violate professional standards or receive sustained poor ratings. Commission terms are defined in the separate Guide Agreement.

7. Intellectual Property

Hotel Brand Assets: Hotels retain all rights to their logos, brand colors, and design philosophies. KHAYBAR may not use these for other hotels without explicit written consent.

Designs Created: Custom designs created by Guides for a specific Hotel project belong to that Hotel. Guides may not reuse designs for other clients without written permission.

KHAYBAR Platform: The Platform itself, including tools, technology, algorithms, and templates, are owned by KHAYBAR and protected by copyright.

8. Pricing & Payment

Pricing is transparent and includes: factory CMT costs (from production partners), fabric costs (based on actual consumption), customization fees, and KHAYBAR's service fee (disclosed separately).

Hotels will receive detailed price breakdowns before order confirmation. Payment terms are Net 30 from invoice date unless otherwise agreed. Late payments may incur a 1.5% monthly interest charge.

9. Order & Production Process

Hotels submit orders through the Platform specifying garment type, customization codes, and employee measurements. Orders undergo compliance review against the Hotel's style guide before production. Production partners are responsible for manufacturing quality and on-time delivery. Lead times and expected delivery dates are specified at order confirmation.

10. Quality & Defects

All garments meet international quality standards. If defects are identified upon receipt, Hotels must notify KHAYBAR within 48 hours with photographic evidence. The production partner will replace defective garments at no charge if notified within 14 days of delivery.

KHAYBAR does not accept returns for fit issues after 30 days from delivery.

11. Limitation of Liability

To the fullest extent permitted by law, KHAYBAR's total liability for any claims arising out of or relating to this Platform shall not exceed the amount paid by the Hotel in the 12 months preceding the claim. KHAYBAR is not liable for:

  • Indirect, incidental, special, or consequential damages
  • Loss of profits, revenue, or business opportunity
  • Delays or failures in production caused by production partners
  • Data breaches by third parties (including production partners)

12. Dispute Resolution

Disputes shall first be addressed through good faith negotiation. If unresolved within 30 days, disputes shall be governed by the laws of [Jurisdiction] and subject to the exclusive jurisdiction of the courts in [Jurisdiction].

13. Termination

KHAYBAR may terminate or suspend a user account if:

  • The user violates these Terms of Service
  • Payment is not received within 60 days of invoice
  • The user engages in fraudulent or harmful conduct

Users may terminate their account at any time by providing 30 days written notice. Ongoing orders will be fulfilled unless cancelled in writing.

14. Compliance & Legal

Hotels are responsible for ensuring their use of the Platform and employment practices comply with all applicable laws, including employment law, anti-discrimination law, and data protection law (GDPR, local regulations).

KHAYBAR maintains a comprehensive compliance infrastructure: a sub-processor register (Art. 28), data classification register (Art. 30), retention schedule (Art. 5), audit logging (ISO 27001 A.12.4), data subject request handling (Art. 12-22), and a breach notification protocol (Art. 33-34).
